DOE, APGA Reach Settlement on Furnace Rule

A final settlement agreement between the Department of Energy (DOE) and the American Public Gas Association (APGA) was submitted to the D.C. Circuit Court of Appeals with a request that it accept the settlement.

Under terms of the agreement, the Direct Final Rule issued in June 2011 would be:

  1. vacated as it relates to energy conservation standards for non-weatherized gas furnaces, including standby and off-mode energy consumption; and
  2. remanded to DOE for a full rulemaking.

This agreement would eliminate the May 1, 2013, effective date for compliance with the Direct Final Rule with respect to non-weatherized gas furnaces.
